The 14th Court of Appeals Affirms Full Defense Summary Judgment Obtained by C&S Partners
The 14th Court of Appeals recently affirmed a full defense summary judgment obtained by C&S Partners T.J. Turner, Zach Bowman, and Ben Evans in Travis County district court on behalf of the firm’s client Kathryn Hale. The plaintiff sued the firm’s client in her individual capacity after settling a dispute with the Westlake Property Owners’ Association. Hale had served on the Architectural Control Committee for the Westlake POA. C&S moved for summary judgment on res judicata, election of remedies, and the one satisfaction rule.
The appeal was transferred to the 14th Court of Appeals, who only had to affirm one of the summary judgment grounds. The Court of Appeals affirmed on the one satisfaction rule. Access the Memorandum Opinion issued by the Court [here].
