C&S secures complete defense summary judgment For Guadalupe-Blanco River Authority


C&S attorneys TJ Turner and Ben Evans recently obtained summary judgment for their client Guadalupe-Blanco River Authority (GBRA) in a complex contractual dispute.  The dispute involved a series of contractual agreements with a real estate developer, plaintiff NBL 300 Group Limited.  NBL accused GBRA of breaching various obligations under the agreement and sought several million dollars in damages. 

The case was pending for four years and was the subject of an interlocutory appeal following an early ruling on a plea to the jurisdiction filed by GBRA and its prior counsel.  GBRA hired C&S after the San Antonio Court of Appeals reversed the trial court’s order on the plea to the jurisdiction and remanded the case for further proceedings.  Turner and Evans took the case over in early 2018, conducted thorough discovery, and successfully moved for summary judgment in early June 2020.
 
“I am proud of our work here,” Turner said, adding “we were able to distill some complex contracts and a complicated timeline down to manageable issues for the court, and we got the right result.”
 
The order granting the summary judgment dismisses all of the plaintiff’s claims with prejudice resulting in a complete defense victory for GBRA.
